Welcome to The Swap Society! These Terms and Conditions (“Terms”) govern your participation in the Swap Society Website and our Membership Community (“the Program”), operated by The Swap Society (“we,” “our,” or “us”). By subscribing to the Program, or using our website, you are forming a binding agreement between you and us and agree to be bound by these Terms.
1. Membership Benefits
By joining The Swap Society, members receive:

Unlimited swapping privileges at all participating locations.

Access to our special swap events, including but not limited to:

Men's Swap

Children's Swap

Things Swap
-
Jewelry Swap
-
Holiday Swap
-
Book Swap
-
Art Supply Swap

Influencer Swaps

Complimentary beverage (when applicable) during swapping sessions.

Guest pass: Members may bring first-time guests to swap with them at no charge.

Access to “Double Days,” where items swap 1-for-2.
-
Entry into our WhatsApp community.
-
Exclusive partner discounts through our Member Perks Program.
2. Swapping Policy

All items presented for swapping must be clean, functional, in usable good condition, and appropriate for the type of swap.

We reserve the right to reject any item at our sole discretion for any reason.

Items accepted for swap become the property of The Swap Society and may be redistributed, donated, recycled, or disposed of accordingly.

Swapping is non-transactional—no cash or resale value is assigned to items.
-
We do not guarantee the availability or quality of any specific item or category.
-
Swapping is subject to available inventory and item categories may have rotation or limitation policies.
3. Children's Items and Health/Safety

All children’s items must meet current safety standards. We do not accept car seats, cribs, or other regulated baby equipment.

While we make efforts to maintain cleanliness and safety, all items are offered “as-is.”

Members accept full responsibility for assessing the safety, cleanliness, and suitability of any item taken.

The Swap Society is not liable for any injuries, allergic reactions, or damages resulting from swapped items.
4. Membership Overview, Fee, Billing, Cancellation & Termination

Membership is billed monthly automatically on a recurring basis until canceled by the member.

Active members may swap unlimited items at any of our approved locations during regular business hours.

Membership benefits are valid only while your subscription is current and paid.

There are no refunds for membership fees, partial usage, or early cancellation.

If payment fails or your account is inactive for any reason, your membership benefits will be suspended until resolved.

Members may cancel their membership at any time via their account dashboard or by contacting us directly community@theswapsociety.com, but no refunds will be issued.

If you cancel your membership, and were on special pricing, it is not guaranteed that special pricing will be available again and by cancelling you forfeit that locked in rate.

We reserve the right to suspend or terminate memberships at our discretion for:

Violating these Terms

Abusive or inappropriate conduct toward staff or other members

Fraudulent or dishonest behavior

No refunds will be issued upon cancellation or termination.

5. Information Sharing & Privacy

By becoming a member, you consent to us sharing your contact and membership information with:

Our trusted partners

Satellite locations
-
Other members (where appropriate, such as for communication or community engagement)

We do not sell your personal data to third parties. Information is shared only to support the function of the Program.

Specifically, your first name and last four digits of your membership number are made available to all partners and satellite locations to verify active membership.

Information you upload to your membership profile is visible to other members.
-
Participation in our WhatsApp community is at your own risk and governed by their Privacy Policy.

6. Community Conduct

Respectful, inclusive, and kind behavior is expected at all times.

Members are expected to treat staff, ambassadors, fellow members, and the space with respect.

Abusive, discriminatory, or inappropriate behavior may result in immediate suspension or termination of membership with no refund.

Swapping is a community-driven activity—please swap responsibly.
7. Item Ownership & Liability

Participation in the Program is voluntary and at your own risk.

Once an item is dropped off and accepted for a swap, it becomes the property of The Swap Society.

We are not responsible for the condition, origin, or performance of items taken by members.
-
All items are accepted and swapped “as-is.”

The Swap Society is not liable for:

Damage, loss, or dissatisfaction with swapped items
-
Injury or harm caused by any item received through a swap
-
Theft, damage, or loss of personal belongings while on premises
-
Members waive any claims against The Swap Society related to their participation.

8. Guest Access

Each member may bring first-time guests to swap for free.
-
Additional guests or repeat guest visits require an active membership.
-
Members are responsible for the conduct of their guests.
9. Modifications

We may update or revise these Terms at any time. Notice of material changes will be provided via email or posted on our website.

Continued participation after updates constitutes agreement to the new Terms.
10. Limitation of Liability

Participation in the Program is at your own risk.
-
We are not liable for any loss, theft, damage, or injury resulting from participation in the Program or use of swapped items.
11. Governing Law

These Terms shall be governed by the laws of the state of Florida
